TERMS AND CONDITIONS OF SALE ON WWW.ARSOC.ORG

 

 

Preamble

 

The present terms and conditions of sale apply between :

 

ARSOC, owner of www.arsoc.org whose head office is located lot cap-sud, 97190 LE GOSIER registered under number 94787865800014.

 

hereinafter referred to as "the Company".contact@arsoc.org

 

And

 

Any natural person acting as an individual or as the representative of a legal entity visiting or making a purchase via the www.arsoc.org website or the Arsoc mobile application belonging to the Arsoc company.

 

Hereinafter referred to as "the customer".

 

Any order placed on the www.arsoc.org website or the Arsoc mobile application implies consultation and unconditional acceptance of these general terms and conditions of sale, as well as the general terms and conditions of use available for consultation.

 

The www.arsoc.org website and mobile application offer a catalog of online training courses for all individuals wishing to learn or progress in the field of languages. These courses are delivered online, via videoconferencing applications and by teachers.

 

As www.arsoc.org is an e-commerce site, the customer acknowledges that he/she has been fully informed that his/her agreement to the content of these general terms and conditions of sale does not require a handwritten signature of this document.

 

The customer is invited to save and print these general terms and conditions of sale, which are binding between the parties.

 

The customer declares that he/she is a natural person of legal age and that he/she has full legal capacity to enter into contracts under French law.

 

 

PurposeThe purpose of these general terms and conditions is to define the rights and obligations of the parties in the context of the distance selling by Arsoc of online training courses on various themes, via various online media (texts, photos, videos, tutorials, quizzes, videoconferencing, etc.). These courses are accessible from the customer's personal space, after the customer has paid for the course package selected.

Enforceability of general sales conditions

The version of the general terms and conditions of sale opposable to the customer is the one appearing on the site at the time of validation of the order by the customer. The various versions of the general terms and conditions of sale are archived by Arsoc. The general terms and conditions of sale may be modified or deleted at any time.

Unavailability of the site

​

The www.arsoc.org website or access to one or more services within the site, such as the online sales area, may be temporarily or permanently closed without notice or compensation, and without any Internet user being entitled to claim any compensation whatsoever. Users who have paid for lessons and have not been able to take them in full will receive a full refund for lessons not taken. On the other hand, no refund will be made for those who have exceeded the validity date of the courses purchased. These validity dates are specified on the presentation of each package.

Courses

 

4.1. Course formulas and availability

 

Courses are sold individually and by the session book for individual courses, or in Pack/formulas for group courses. Details of each course, together with a summary of its content and conditions, are given on the course's product sheet. These conditions remain available in the offer description visible on the www.arsoc.org website.

 

The student user has access to the course after making an appointment in his/her user account after payment, in accordance with the conditions specified in the product sheet. For group courses, however, users must contact the owner of the contact@arsoc.org website to set up one or more classes, according to level and at specific times. However, Arsoc may put the site or one or more classes under maintenance in the event of a technical problem or in order to improve the technical service provided. This may lead to a temporary interruption in access to the various courses, without entitling the participant to any compensation whatsoever, as the courses are delivered via third-party videoconferencing platforms.

 

Once payment has been received by Arsoc, a link to the videoconferencing course is sent and/or made available on the platform so that the user can be put in touch with his or her teacher.

 

 

All courses appear on the customer's personal space for the entire duration of the selected package.

 

4.2 Backup

 

In accordance with the general terms and conditions of use, Arsoc's sole obligation is to connect users and teachers. Videoconference lessons cannot be saved or shared by the user under any circumstances. These courses remain the property of Arsoc.

 

4.3 Information / Guarantees

 

The greatest care is taken in setting up and scheduling courses, prior to placing the order, with information relating in particular to the essential characteristics of the courses offered for sale, and to payment methods. However, there may be slight variations in the representation of the course(s), which do not affect the essential characteristics. Arsoc cannot be held contractually responsible for such variations.

 

The student user declares that he/she has received all useful information and advice enabling him/her to make, under his/her sole responsibility, all decisions relating to the choice of course(s). The customer has verified that the course(s) meets his/her needs and that he/she has the software required to connect with the teachers via videoconferencing.

Arsoc uses a written and oral test to assign users to a language level group. The hours indicated in the individual and group formulas are the hours required to move from one level to another.(For example: 90 hours corresponds to the passage from A2 to B1 level).This number of hours is the average learning time observed by teachers and necessary to pass from one language level to another. The addition of a few hours may be necessary and will be estimated by the teacher in order to validate the objective.Arsoc cannot be held responsible for the client's assimilation of the lessons, which depends in particular on the client's assiduity and seriousness in understanding and using the notions learned in the lessons.

 

Prices

The prices displayed on the Arsoc website and mobile application include all taxes. They are clearly indicated on each product sheet.

 

Any change in the applicable VAT rate will be immediately and automatically reflected in the prices of all products offered for sale on the site and mobile application.

 

The student-user will receive an e-mail confirmation of his/her order on which the total amount of the order will be indicated including all taxes. However, these prices do not include any communication costs related to the use of the online sales and videoconferencing service, which remain the sole responsibility of the student user.

Order process on www.arsoc.org

 

In order to place an order and in accordance with the general conditions of use, the student user must create an account on www.arsoc.org. The creation of an account is free of charge and requires the entry of an active e-mail address and a strictly personal and confidential password.

 

The account enables the customer to access www.arsoc.org services, and can be accessed using the customer's e-mail address and password.

Purchase order

 

7.1. Ordering

​

Ordering includes the following steps:

Selecting a product (individual lessons, session packs, formulas, etc.)

creation of a student user account. Filling in the mandatory fields on the identification and/or information forms. The customer certifies that the information provided is true and accurate.

login to your student user account

​

Order validation and payment.

​

Receipt of electronic order acknowledgement.

Immediate access to videoconference course links in the customer's student account.

Any order placed by the customer via the above steps constitutes irrevocable acceptance of the general terms and conditions.

Order confirmation

​

In accordance with applicable regulations, contractual information will be confirmed electronically to the e-mail address indicated by the customer on the order form.

It is the customer's responsibility to keep the contractual information on the medium of their choice.

The order only becomes final after the 14-day legal retraction period. Courses will begin after these 14 days and after receipt of the first payment, mentioned in the training contract.

Termination of training

​

The customer has 14 days in which to withdraw from the contract with ARSOC, without being required to pay any compensation.

If the cancellation request is received by ARSOC after expiry of the withdrawal period and before the start of the training course, the Training Organization will retain 30% of the total price of the training course as compensation, except in cases of force majeure ;

Once the training has begun, if, due to a duly recognized case of force majeure (an unforeseeable, insurmountable event beyond the control of the individual), the individual customer is unable to continue the training, the contract is terminated ipso jure and the training services actually provided are invoiced on a prorata temporis basis of their contractual value. In the absence of force majeure, ARSOC reserves the right to withhold the full amount of the training course as compensation in the event of cancellation, abandonment or interruption.

Force majeure

The Customer may terminate the contract in the event of force majeure. The request must be sent to ARSOC at contact@arsoc.org. In this case, only the services provided will remain the responsibility of the Customer, in due proportion to their value.

 

Payment

​

10.1. Payment methods

​

Payment can be made

- online by credit card via the "mollie" payment platform

- By bank transfer to the ARSOC account.

 

10.2. Property

​

The online courses remain the property of Arsoc under copyright law. They may not be copied, transmitted or distributed. They are made available to the student user for his or her own personal use only.

The student user accesses the courses in compliance with the general terms and conditions of use, to which he/she subscribes in full on his/her first order.

Intellectual Property

​

11.1 General information

​

In accordance with the general conditions of use, the website, mobile application, brands, course documents, drawings, models, photos, images, trailers, video courses, texts, graphic charter, logo, tutorials, etc. (non-exhaustive list) are the exclusive property of Arsoc.

The general terms and conditions of sale do not imply any transfer whatsoever of intellectual property rights and copyrights on the elements belonging to the company to the benefit of the student user.

All video lessons, their use and distribution are strictly reserved by the company under copyright law.

 

11.2. License

​

The courses are reserved for individuals or legal entities for exclusively personal and nominative use. The license does not apply to training bodies or collective organizations.

Liability

Arsoc cannot be held responsible for the non-performance of its obligations due to a case of force majeure as generally accepted by French law and courts or for causes beyond its control (constraints and limits of the Internet network, network failure, slowness or interruption of the customer's Internet service provider, etc.).

 

Duration

​

The present conditions apply for the duration of the online services offered by Arsoc.

 

Proof

​

Computerized registers, kept on Arsoc's servers or on those of its hosts, will be considered as proof of communications, orders and payments between the parties.

​

Applicable law

​

These terms and conditions are governed by French law. This applies to both substantive and formal rules. In the event of dispute, in the absence of amicable agreement, the competent French courts shall have exclusive jurisdiction.
